By accessing and using the Klazi Stella website at www.klazistella.com, you are accepting and consenting to the practices in these terms of use.
“Klazi Stella” (“we”, “our”, “us”) means its successors and assigns or any person acting on behalf of and with the authority of Klazi Stella, ABN 85 806 593 449. "Rental Period” means the weekend hire or 4-day period that the User booked the garment for.
“Rental Price” (“price”) means the cost of the hire of the garment as agreed between Klazi Stella and the User.
“Rental Return Due Date” means the date the garment is expected to be back at Klazi Stella’s address.
Any instructions received by Klazi Stella from the User for the hire of garment and/or the User’s acceptance of the garment supplied on hire by Klazi Stella shall constitute acceptance of the terms and conditions contained herein.
Price and Payment:
The price shall be Klazi Stella's current price, at the date of delivery or collection of the garment, according to Klazi Stella’s current price list as detailed on Klazi Stella's website. Klazi Stella reserves the right to change the price in the event of a variation to the User’s requirements. Payment may be made by card (Mastercard and Visa accepted) or by any other method as agreed to between between Klazi Stella and the User.
Failure to make payment for an invoice for repair, replacement or late fees will be directed to a selected debt recovery institution. All fees incurred in such services, will also be payable by the User.
Cleaning fee:
Our hire prices stated on website include the cleaning fee. We are responsible for the cleaning of the item. User shall not attempt to clean the garment themselves under any circumstances. If the dress is heavily stained, especially with fake tan, we reserve the right to charge an extra fee of $30. In the event that fake tan stains a garment, perfume, or any other stain damages the fabric and prevents it from being rehired (meaning the not removable), Klazi Stella reserves the right to charge the User 200% of recommended retail value stated in item description. The User expressly authorises Klazi Stella to deduct such additional cleaning fees from the User’s credit card which was provided at the time of placement of the User’s order.
Sizing:
Our size information is a recommendation only. Please ask us prior booking about the fit when unsure or try on the garment at our home office in Brisbane.
Cancelled Order:
Klazi Stella may cancel your order. Due to an unforeseen event, the item you ordered suddenly became out of stock and is no longer available. If an item in your order does become unavailable, you will be contacted about the cancellation. If your order contains additional items, these items will still be shipped to you and the unavailable item will be removed from your order. You will not be entitled to claim any additional amounts or seek compensation for any loss, expense or damage (either direct or consequential) or for any loss of time or inconvenience, which may result from such cancellation. You will receive a full refund in case we cancelled your order. If an order was placed without checking availability or if you have exceeded the 5 hour window that we kept the item on hold for you, a cancellation fee of $50 is applicable. You will be refunded the balance to the card you payed with. To cancel an order from your end, please contact our Customer Service. We do not refund payments for any cancellation. If you contact us after dispatch of the garment, the rental period automatically started.
Refunds:
Unfortunately, we do not offer refunds for a change of mind, cancelled events, if the item doesn't fit, or if the item does not arrive on time as we are not liable for Australia Post. Therefore we ask that you carefully choose your item before ordering with us.
Rental Period and Late Fees:
The rental period shall commence from when the User (or a third party nominated by the User) signs the Courier’s delivery receipt and shall continue until the garment is lodged at the post office for its return. The item will arrive either one day before requested event date or on the day, depending on when the order was placed. Weekend hire returns have to be lodged over the counter at the post office on Monday before 12pm (midday) and must obtain a lodgement receipt.
Where the garment has not been returned to Klazi Stella by the Rental Return Due Date then Klazi Stella shall be entitled to charge additional hire fees until the garment is returned to Klazi Stella. The User expressly authorises Klazi Stella to deduct such additional hire fees from the User’s credit card which was provided at the time of placement of the User’s order. Such additional charges shall be charged a fixed fee of $80 for each day overdue. This fee will be applicable up to 14 days from the Rental Return Due Date.
If the User has not returned the rental item(s) within 14 days after the return date, Klazi Stella will consider the rental item(s) as non-returned and will charge the User’s credit card 150% of the recommended retail value stated at item description. The rental fee and late fee's will not be subtracted. Therefore the User is required to pay for the late fees and 150% of the RRP for the garment.
Shipping Policy:
Klazi Stella’s standard delivery method is Express Signature operated by Australia Post. Klazi Stella has an additional fixed postage fee of $25 (which includes express postage to the User and a return satchel to return the garment back to Klazi Stella). For formal gowns, our additional fixed postage fee is $50. Please be aware that you will bear the risk of delivery. Your order will be shipped timely to arrive on hire date (same day or day before). Earliest possible shipping is on the next business day (requiring arrival of order until 6pm the previous day). Please calculate a timely order as we are not reliable for late delivery. Pick up must be liaised prior hire.
Please consider the security circumstances of your delivery address, as we cannot be held responsible for stolen or misplaced parcels. Full tracking is available using this service. We are not liable for postage delays, stolen or misplaced parcels caused by our postal service, Australia Post.
Please notify us if you live in a regional area and are aware that express postage does not arrive for you the following day. Without such notification, we are not liable for garments not arriving on time for your date of hire.
Reliability/ Damage:
The User shall inspect the garment on delivery and shall within four (4) hours of receipt of the garment notify Klazi Stella (by phone or email) of any alleged defect, shortage in quantity, damage, failure to comply with what was ordered. Klazi Stella retains property in the garment nonetheless all risk for the garment passes to the User by time of sending at post office. The User accepts full responsibility for the safekeeping of the garment. It is the User's liability to rent timely/ in advance for Klazi Stella to be able to send the garment in time. If you live in a rural area and the garment does not arrive prior event we will not refund.
Customers will not attempt to clean, repair, or alter garments at any time without consent from Klazi Stella:
If the garment gets damaged or has been returned with wear and tear, the client will pay the repair/alteration fees. A quote will be provided by Klazi Stella. The customer will not arrange repair. In addition to the repair fees, customer shall pay loss of business and possible loss in value of item. If the item is damaged at a visible area affecting the look and quality of the garment and or the damage cannot be repaired in a manner that the garment becomes unable to hire, the customer will pay 200% of RRP stated on website or seek for replacement of garment within 7 days.
If the garment gets lost, stolen or damaged beyond repair, whether or not such loss, theft, or damage is attributable to any negligence, failure, or omission of the User then the User will be liable to pay 150% of the RRP stated at the item description at Klazi Stellas' website (or if no RRP stated, the general RRP by the designer).
The customer is liable to pay the lost business of the hire fee of the following week, if the garment was booked by the next customer and cannot be supplied due to delay caused by customer. We advise that clients who intend to hire items be extra mindful if using fake tanning products or perfume. In the event that fake tan stains a garment or perfume damages the fabric and prevents it from being rehired, Klazi Stella reserves the right to charge the User 150% of recommended retail value stated in item description.
Returns:
Please take care when choosing a garment to be as certain as possible it will fit you. We endeavour to be as specific as possible describing the size and fit of garments to ensure you are choosing an item that will fit you. We can unfortunately do not provide you with a refund if you choose not to wear your garment for your event/occasion.
Returning your garment is quick and easy. Simply place it in the provided prepaid return satchel and lodge it at your nearest Post Office over the counter on Monday before 12pm (weekend hire) or on the day after event. Please lodge the return at the post office and obtain a receipt for proof of shipping.
Exclusion from Hiring Service:
We reserve the right to exclude individuals from our hiring service.
Limitation of Liability:
Klazi Stella will in no way be liable for any direct, indirect, incidental, special or consequential damages, resulting from use or inability to use the website or for the cost of procurement of substitute products or resulting from any products purchased or obtained or messages received or transactions entered into through the website or resulting from unauthorized access to or alteration of your transmissions or data or of any information contained on this website, including but not limited to, damages for loss of profits, use, data or other intangible, even if we have been advised of the possibility of such damages.
Where any Act of Parliament implies in the Terms and Conditions any term, condition or warranty, and that Act avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of, or liability under such term, condition or warranty, such term, condition or warranty shall be deemed to be included in the Terms and Conditions, however, the liability for us on any breach of such term, condition or warranty shall be limited, at our option, to any one or more of the following:
if the breach relates to goods;
the replacement of the goods or supply of equivalent goods;
the repair of such goods;
the payment of the cost of replacing the goods or of acquiring equivalent goods; or
the payment of the cost of having the goods repaired; and
if the breach to relates to services:
the supplying of the services again; or
the payment of the cost of having the services supplied again.
